The document below represents the Terms and Conditions (the “Agreement”) that apply to the relationship between CS Juvenes and you, as a user of the Website and participant in CS Juvenes sports activities. Please read this Agreement carefully.

      I.  Website owner

1. THE JUVENES SPORTS CLUB ASSOCIATION (CS Juvenes) is the operator of the website csjuvens.ro.
2. CLUBUL SPORTIV JUVENES ASSOCIATION is a sports club association organized and operating in accordance with the laws of Romania, based in Mun. Târgu-Mureș, Piața Republicii Nr. 41, Jud. Mureș, with CUI 30940785, registered in the Register of Associations and Foundations with no. 3290/A/2012.

     II.  Obligations of website users

1. This Terms and Conditions document applies when you use our website and participate in CS Juvenes sports activities.
2. The Terms and Conditions below, together with the documents that form an integral part of these Terms and Conditions, namely the Personal Data Processing Policy, additional information displayed on the Website or communicated by CS Juvenes team members for various sports (hereinafter collectively referred to as the “Terms and Conditions”) constitute the applicable contract in the relationship between CS Juvenes and persons using the Website and participating in CS Juvenes activities.
3. By using the Website and participating in the sports activities organised by CS Juvenes you expressly declare that: you have read these Conditions, you fully and unconditionally agree with the clauses of the Conditions and the documents that form an integral part of the Conditions and you understand that compliance with the Conditions is binding.
4. We reserve the right to restrict access to the website to persons who violate these Terms. We have the right to restrict access to persons who act contrary to law, morality or good faith or who may in any way harm CS Juvenes or third parties.
5. Use of the website may only be made by adults or minors with the consent and under the supervision of an adult with full legal capacity. By using the website, you confirm that you comply with these conditions.
6. If you use the website on behalf of another person, you must be authorised to do so. Otherwise, you are liable for any damage caused to us or third parties.
7. By using the website you agree that any communication regarding the operation of the website, changes to these Terms, your obligations, our obligations or activities carried out in our legitimate interest will be made electronically, in particular via the website or email, using data you have provided to us. You agree that electronic communication via the website or email is considered written communication and, for the purposes of preservation, you agree that we are authorised to store such communication in an unaltered form. The date of receipt of such notices shall be deemed to be the date on which such notice is given.
8. By using our website, the user assumes in relation to CS Juvenes and in relation to other users the following:

          a)   Responsibility for the activity carried out on the website.

          b)  Acknowledge that CS Juvenes has no obligation to verify the accuracy of the information provided by the user and that CS Juvenes will not be liable for false or misleading statements made by the user. CS Juvenes shall not be liable for any damages suffered as a result of incomplete or incorrect data provided by the user.

          c)  Acknowledging that CS Juvenes has no obligation to verify the accuracy of the information provided by users, CS Juvenes will not be liable for false or misleading statements made by the user, therefore CS Juvenes is not responsible for any consequences that may arise as a result of such actions.

          d)   It is possible to see advertisements and links to other websites and resources of third parties in the webiste.

9. CS Juvenes may ask you to express your agreement to these Terms by a specific action, which has the meaning of an unequivocal consent (e.g. by ticking a specific box). By using the website and checking the relevant box you agree to comply with all the terms of these Terms and consent to the collection, storage and processing of personal data as described in these Terms and in the Personal Data Processing Policy.

     III.  Online registration for the various sports promoted by CS Juvenes

1. In order to register online for the various sports branches promoted by CS Juvenes, the steps are as follows: you fill in the information requested through the registration form available online on the website, in your personal name or on behalf of the minor child you represent and then you need to accept the Terms and Conditions detailed in this document and the Personal Data Processing Policy. Proof of successful registration is the receipt of a confirmation message.
2. As a participant in CS Juvenes sports activities, you are obliged to respect the rules that CS Juvenes communicates orally or in writing for each sport branch.
3. The registration of underage children for sports activities can be done by the legal representative of the minor (parent or guardian). By registering minors online, the legal representative who fills in the form available online expressly consents to the processing of the personal data that he/she enters in the form for the purpose of registration and the carrying out of the sports activities in which the minor child is registered and participates within CS Juvenes.

     IV.  Intellectual property rights

1. Any content element of the website (such as trademarks, logos, images, text, graphics, audio and video files) belongs exclusively to CS Juvenes and our partners and is protected by intellectual property law. This content may not be copied, disassembled, modified, reproduced, published by any person without the prior written consent of CS Juvenes. Any unauthorized use of these materials constitutes an infringement of intellectual property rights and will result in civil and/or criminal liability.
2. Users have, during the contractual period, a right to use elements of the website that are strictly necessary for the performance of these Conditions.
3. We reserve all rights not expressly granted by these Conditions.
4. If you consider that any information available on the website infringes copyright law, please inform us at office@csjuvenes.ro so that we can take the necessary legal steps.
5. By publishing content via the website or social media pages on which CS Juvenes has an account created, you transfer to us worldwide, free of charge, unlimited in time and irrevocably the non-exclusive copyright to multiply and distribute content created by you for the purpose of distributing it within the website or on the social media networks on which CS Juvenes has a page created (Instagram, Facebook, etc.). This copyright is transferred in exchange for the right granted by us on the use of the website and is for the duration of copyright protection of the material in question. Due to the nature of the internet, we do not have full control and do not take responsibility for how third parties distribute content created by you.

     V.  Privacy and access to personal data

1. Any information provided, by written or oral means, in communications between CS Juvenes and users during the term of the Terms is confidential information.
2. CS Juvenes has access to personal data that users of the website and participants in CS Juvenes’ sports activities provide for the purpose of using the website and participating in sports activities. Detailed information on how personal data is processed by CS Juvens in this regard is provided in the Personal Data Processing Policy published on the website.

     VI.  References to third-party sources

1. The website may contain external links (links, banners, advertisements) or references to other websites/platforms (e.g. Facebook, YouTube) that CS Juvenes does not own. Specific terms and conditions of use apply to the use of those websites/platforms and CS Juvenes is not responsible and assumes no liability for their content. Please read the policies of the respective companies before agreeing to the processing of any personal data belonging to you.
2. No link to other sites/platforms can be qualified as an approval or endorsement of them. You agree that, to the extent permitted by law, CS Juvenes or our partners cannot be held liable for the content or availability of such sites/platforms.

 VII.  Limitation of liability CS Juvenes

1. CS Juvenes accepts no liability for any of the following matters that may arise in connection with the use of the website or participation in sports activities: (i) loss of profits; (ii) loss of sales volume or losses; (iii) loss of contracts; (iv) damages or losses arising from participation in activities organised by CS Juvenes.
2. CS Juvenes provides access to the Website on an “as is” and “as available” basis without warranty of any kind, express or implied. Our services may be subject to limitations, delays and/or other problems inherent in the use of the Internet and electronic communications. You agree that you use the website at your own risk.
3. To the extent permitted by law, we do not warrant that the website, the servers on which the webiste is hosted or the email services are free of viruses or other destructive programs.
4. CS Juvenes may sell or subcontract the rights and obligations subject to these Terms to the extent that we have a legitimate interest and this does not cause CS Juvenes to limit the rights CS Juvenes customers have under the law. Users may not assign, subcontract or transfer the rights and obligations subject to these Conditions, in whole or in part, except with the express prior consent of CS Juvenes.
5. CS Juvenes has the right to modify or remove various features of the website or sports activities it promotes, in whole or in part, at any time, and without prior notice to you. You agree that such changes may cause disruptions to the operation of the website and CS Juvenes cannot be responsible for them.
6. By using the Website and participating in CS Juvenes activities, you agree to indemnify us and hold us harmless, to the extent permitted by law, from and against (i) any breach of these Terms by you and (ii) any claim made against us by a third party arising from your breach of the Terms.

 VIII. Force majeure and fortuitous event

1. A party who proves that non-performance, late performance or improper performance of its contractual obligations is caused by force majeure or unforeseeable circumstances shall be exonerated from liability.
2. CS Juvenes shall be exempt from compensation for any direct or indirect damage suffered as a result of (i) unforeseeable and unavoidable events beyond its control, listed by way of example: war, acts of authorities, whether legal or illegal, state of emergency, epidemic, pandemic, natural disaster, explosion, fire, technical malfunction or failure of the website or equipment, fire, destruction of equipment and installations, breakdown or prolonged interruption of transport, telecommunications or electricity supply, computer viruses, cyber-attacks, internet connection failures, unauthorised access to systems or (ii) in the case of fortuitous events relating to relatively unforeseeable and invincible circumstances not of an extraordinary nature such as legal restrictions, inability to use the website, strikes and other similar events.
3. If within 15 (fifteen) days from the date of its occurrence, the event does not cease, either party shall have the right to notify the other party of the automatic termination of these Conditions, without the parties being entitled to claim damages.

 IX.  Modification of Conditions. Termination of the contractual relationship

CS Juvenes reserves the right to modify all or part of these Conditions without prior notice to the users of the website. When you return to the website, please check the date of the last update of these Terms. Using the website or participating in sports activities after the changes have been applied implies that you have agreed to the new Terms. Changes to these Terms shall enter into force on the date published on the website.

 X.  Interpretation, invalidity, litigation

1. The section headings in these Conditions are inserted for reference purposes only and shall not affect their interpretation.
2. CS Juvenes’s failure to exercise or unsuccessful exercise of its rights under these Terms shall not constitute a waiver of its rights. No separate or partial performance of any obligation shall preclude full performance of any such obligation.
3. If any provision of these Conditions shall be declared null and void by a change in law or by a decision of the courts, this shall in no way affect the validity and enforceability of the other provisions of the Conditions. The parties shall use their best endeavours to amend the clause in question while preserving the purpose of these Conditions.
4. The law applicable to these Conditions is Romanian law. In the event that the parties are unable to resolve their differences amicably, the competent courts shall, to the extent permitted by law, be those of Târgu-Mureș.
5. By accepting these Conditions, you express your consent to abide by them.
