With this Information Notice on the processing of personal data we inform you about how your personal data are processed (i) when you visit or use the website csjuvenes.ro, operated by the JUVENES SPORTS CLUB ASSOCIATION (hereinafter referred to as “CS Juvenes”, “we”, “us” or “we”) and (ii) when you register and participate in sports activities organized by CS Juvenes.

CLUBUL SPORTIV JUVENES ASSOCIATION is a sports club association organized and operating in accordance with the laws of Romania, with headquarters in Mun. Târgu-Mureș, Piața Republicii Nr. 41, Jud. Mureș, with CUI 30940785, registered in the Register of Associations and Foundations with no. 3290/A/2012.

By using the website or participating in the events organized by CS Juvenes you express your agreement with this Information Notice on the processing of personal data. If you do not agree with this Information Notice, please do not use the website or participate in sports activities organised by us.

     1.  Purpose of the Personal Data Processing Policy

When you visit, use our website or register and participate in sports activities organised by CS Juvnes , we process a number of your personal data as described below. In the view of the legislation on the protection of personal data, CS Juvenes is in this case the Personal Data Controller and you are the Data Subject. Please read this Information Notice carefully to understand how we process your personal data.

This Notice is formulated in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), also known as the “GDPR Regulation”.

The processing of personal data is the set of operations we may carry out on your data, such as: collecting, storing, organizing, transferring and deleting data.

This Notice on the processing of personal data is an integral part of the Terms and Conditions regarding the use of the CS Juvenes website and registration and participation in sports activities organised by us.

     2.  What data do we collect and on what legal basis?

Your personal data may be collected by us:
• directly from you
• observed by us when you browse our website.

     A.  Personal data provided directly by you

a) You have the opportunity to register and participate in one or more of the sporting activities indicated on the website.

We will process your personal data (i) in order to take steps at your request prior to the conclusion of a contract and in order to fulfil our contractual obligations with regard to your participation in the activities and the organisation of the activities, (ii) to be able to prepare the materials necessary for the running of the sporting events (e.g. issuing of participation diplomas, badges) and for (iii) the running of the activities, events and competitions specific to the branch of sport in which you have registered.

The data processed are those indicated by you at the time of registration, carried out at our premises or indicated online by filling in the registration form. We also process your personal data or the data of the minor child you represent that you provide us with for the purpose of concluding the contract between us and carrying out the sports activity.

We may use your personal data to send you important information about the website, our contract, this Data Processing Policy or other CS Juvenes regulations that concern you. This information will relate strictly to our legal or contractual obligations or to your or your minor child’s participation in CS Juvenes activities.

b) You have the possibility to contact us by e-mail and telephone number indicated on the website.

The data you enter in the e-mail or communicate by telephone – your name, your e-mail address, the message sent – are collected directly from you and are processed on the basis of our legitimate interest in responding to your request and keeping a record of the requests made by persons contacting us.

c) In order to issue invoices for your participation in sports activities, we process the personal data of persons who register for sports activities to a limited extent in order to fulfil our legal obligation to issue a tax invoice. The legal basis for processing this data is the fulfilment of our legal obligations.

In the above cases, your data is processed through our IT service provider; and the website hosting provider Hetzner Online GmbH. These companies store the data on servers located in the European Union.

d) During the course of sporting activities, including at various competitions or award ceremonies, we may take photographs or video footage in the premises where the sporting activity takes place.

For this purpose, photos or films may be taken in the competition hall which may capture your image and voice or that of the minor child you represent. Once they are published, we may also mention your name or that of your minor child.

We process these images in view of our legitimate interest to promote online the sports activities we organise, on the website and on social networks where CS Juvenes has a page created (e.g. Facebook). Therefore, the legal basis for processing your image is our legitimate interest.

By participating in sports activities organised by CS Juvenes you implicitly consent to the processing and reproduction of your personal data consisting of your image and voice or your minor child’s image and voice, as described above. If you do not want us to process this data or if you do not want a particular photo or video to appear online, please communicate your refusal orally and clearly to the photographer, coach, instructor or sports club coordinator present at the activity and then communicate your refusal in writing to office@csjuvenes.ro.

The content remains public, until you ask us to delete it, for the duration of the existence of the website or social media pages we have an account on.

We may also ask you, before activities or by electronic means, for your consent to photograph and reproduce the image of the minor child you represent, in order to promote sports activities on the website and social networks where CS Juvenes has a page created.

e) Newsletter – You can subscribe to the newsletter sent by CS Juvenes for the purpose of sending you information by email, including personalizing the message to you or improving this service.

The legal basis for this processing is consent. For this purpose we collect the email address you indicate and the way you interact with the emails sent by us. The data is kept until you withdraw your consent or when we notice that the messages no longer reach you.

     B.  Traffic data, collected automatically while browsing our website

Our website automatically collects certain information in our legitimate interest in order to ensure its security and optimal functioning. The basis for the collection of this data is our legitimate interest to ensure the security of the website and its optimization. Our purpose is not to use the traffic data we have access to in an attempt to identify individuals based on their IP address.

This information collected by us is traffic data automatically sent by your browser, collected by us or through third party services: Google, YouTube, Meta (Facebook, Instagram) is statistical data, in anonymous form, which although individually (or in isolation) may not lead to direct identification, by correlation with other data sets, in exceptional situations have the potential to be used to identify a person, such as: the location of the device from which you access the internet, determined on the basis of your IP address or with your consent, provided through the device used for access, the browser used for browsing, its version and functions, other information accessible through the browser or application used, such as the operating system version or resolution used on your device, the names of pages accessed and/or files downloaded, the source of the previous page.

We use cookies and similar technologies on the website. Cookies are small tracking files that a website stores in the user’s browser to save data that can be used for functional purposes (e.g. the fact that you are logged in) or for tracking purposes (e.g. the duration of a visit, the source of a campaign that brought you to us). If you visit that website again, it will be able to read the previously stored information and recognise you.

Cookies do not contain software, viruses or spyware and cannot access information on the user’s hard drive. Only the issuer of a cookie can read or modify the information contained in that cookie.

The cookie files used fall into 2 categories:

  1. Internal cookies/”First-party cookies” are cookies set by CS Juvenes or on our behalf on the website. They can be (i) session cookies – stored on your device only while you visit the website and expire once you close your browser and (ii) persistent cookies – stored for a period of time on your browser and after you stop using the website, they are set to expire on a set date or when they are manually deleted;
  2. Third-party cookies are cookies set by other companies and whose functionality is embedded in our website (e.g. google.com cookies).

We use Google Analytics, a web analytics service provided by Google Ireland Limited. Google Analytics uses cookies to analyse how users use a website. The information generated by these cookies is transmitted to and stored by Google Ireland Limited on various Google servers, some of which are located outside the European Economic Area (EEA). Google uses the information obtained to compile reports on website activity.

The statistical data to which CS Juvenes has access, as a beneficiary of Google Analytics services, is anonymised.

How is consent obtained from website users?

When you first access our website, a banner will appear asking you to agree to the use of certain cookies. It is important to know that all unnecessary cookies, i.e. those coming from domains other than pioncampion.ro, are disabled by default.

Within the banner you are given the option to reject, allow or individualise the cookies you want active. You also have the possibility to change your settings at any time and to find out more about the cookies that can be activated on the website. At the bottom left of the main pages of the website and throughout the navigation within the domains, you have access to the management interface of cookies and similar technologies.      C.  Data collected as Associated Operators

In the case of CS Juvenes pages within the various social networks, we only collect your data for normal social network interaction when you: subscribe to our pages, leave comments on our posts, Like/Share or write us a direct message. In these cases, we have access to your public profile, the reaction you had to the date and time of the message/comment.

The data is collected in conjunction with Facebook or another social network with which we are a partner Operator. The legal basis for collection is your consent. The data is used for the purpose indicated by you: to publish your comment or to be able to reply to your message to us. The data is kept until: you close our social media page, you withdraw your previously obtained consent via social media, or you request us to delete this information.

When you interact with our pages on various social networks, those networks process some personal data, on the basis of which they provide us with aggregated statistics. These statistics do not directly contain personal data, but only information such as: the number of views of our page, the number of people who have been shown content from our page, the number of likes our page has.

Our accounts on the various social networks are created under the conditions imposed by those networks. For more details about the processing of your data through these networks, please read their personal data processing policies.

     3.  How do we store and protect your data?

CS Juvenes securely stores your data on servers located in the European Union.

CS Juvenes implements appropriate technical and organisational measures to ensure the security, confidentiality, integrity, availability and protection of data against destruction, loss, alteration, unauthorised disclosure or unauthorised access to personal data processed.

Some of the technical measures are: the use of cryptographic systems for medium and long-term data storage; the use of anti-virus solutions on the computer systems used; encryption of electronic communications.

Some of the organisational measures are: providing expert legal support on local and international legislation with implications on personal data; establishing contractual obligations with our partners and employees regarding confidentiality and protection of personal data.

Your personal data that we process is limited to that which is necessary, appropriate and relevant for the purposes stated in this Information Notice.

Even though we strive to provide as much security as possible to your data, we point out that we cannot guarantee the security of transmitted information 100%, given the lack of security of data transmissions made via the Internet due to external factors such as: viruses or malware, loss of electronic devices from which you access the website, access of unauthorized persons to your electronic devices, insecurity of some wifi networks.

For better protection of your data, we recommend:

–   In your dealings with us, do not disclose personal data unless expressly requested to do so;

–   Choose strong, complex passwords for your electronic devices (use a password manager), unrelated to your personal life and save them in a secure way;

–   Secure your electronic devices with passwords or other locking modes;

–  Don’t leave your electronic devices unattended;

–   Verify the identity of the people you communicate with to make sure you are not sharing personal data with people who are not legally representing us.

     4.  How long do we keep your personal data?

The data collected will only be kept for a certain period of time, depending on the needs and purpose of the processing.

If you have chosen to register for one or more of the sports branches promoted by CS Juvenes, the personal data you enter in the registration form is kept for a maximum time equal to the duration of the applicable general statute of limitations, which runs from the date of termination. Likewise, if you have chosen to write to us by e-mail or contact us by telephone, your data will be kept for a maximum period equal to the duration of the applicable general limitation period, which runs from the final settlement of your request.

Photos or videos on the website and social media are kept until: our website is closed; you request that we delete photos or videos of you or the minor child you represent; our social media page is closed; you withdraw your previously obtained consent via social media or you request that we delete this information.

Data obtained for processing based on your consent will be kept until you withdraw your consent. We will not keep evidence of your consent longer than necessary to comply with our legal obligations or to establish, exercise or defend a right in court.

After the expiry of the periods indicated above, your data will be deleted by the persons authorised to do so.

     5.  With whom do we share your personal data?

In accordance with the above purposes, your personal data will not be sold or rented to third parties.

We will share the necessary part of your personal data only to the extent necessary and only to the following categories of third parties:

a) In the event that you choose to use our website, we may provide your personal data to our processors:

  • the company that provides us with certain services, as indicated in Section 2 of this Information Notice (e.g. the company that hosts our servers, the campaign that administers our website – SC Reea SRL; the technical provider for the newsletter, the traffic analysis service, banking service providers) ;
  • archiving services in physical and/or electronic format; legal, notarial, accounting or other consultancy services.

The third parties indicated above who have access to your personal data are obliged, according to the legislation in force or the contracts we have concluded with them, to use the personal data to which they have access only for the purpose of providing the service for which we have contracted them.

b) Public authorities and institutions, if we are legally obliged to disclose it.

c) We may disclose your personal data to third parties:

–   If you request or give us your consent to do so;

–   If those persons can demonstrate that they have the legal authority to act on your behalf;

–  Where we have a legitimate interest to administer, expand or develop our business: where we sell part of our business or certain of our assets, we may disclose your personal data to the prospective purchaser; where CS Juvenes or a substantial part of CS Juvenes’ assets is acquired by a third party and the personal data held by us will be part of the transferred assets;

–   In order to respond to any claims, to protect the rights of a third party, to protect the safety of any person or to prevent any illegal activity;

–   For the purpose of protecting the rights of CS Juvenes or our employees and customers and others.

     6.  Transfer of personal data outside the European Economic Area

CS Juvenes stores the personal data it processes on servers located in the European Union.

However, some personal data to which we have access may be processed by third party companies operating outside the European Economic Area (EEA). Where we provide any personal data to companies operating outside the EEA, we will take appropriate steps to ensure that they provide an adequate level of protection to the data to which they have access. These measures include entering into contracts in accordance with the standard clauses approved by the European Commission or if the company in question receives a general authorisation to subcontract with any other EU/EEA supplier with an adequate level of protection recognised by decision of the European Commission. Where appropriate, we also implement additional protection measures, such as encryption and/or pseudonymisation.

     7.  What are your rights and how do you respect them when you are an Operator?

Personal data legislation gives you a number of rights in relation to your data; below we give you details of these and how you can exercise them:

a) Right of access – you have the right to request information about your personal data that we process, including the purpose of the processing, whether and with whom it is shared and how long it will be kept.

b) Right to rectification – if your data processed is inaccurate, you have the right to have it rectified or completed.

c) Right to erasure of data (“right to be forgotten”) – you have the right to ask us to erase your data, except where the data is necessary for: exercising your right to freedom of expression and information; fulfilling a legal obligation incumbent on us and/or a task carried out in the public interest; in the public interest, for scientific, historical or statistical research purposes; formulating, exercising or defending a right in court.

d) Right to restriction of processing – you may request restriction of the processing of your personal data if: you dispute the accuracy of the data, for the period during which we verify the accuracy of the data; the processing is unlawful and you object to the erasure of the personal data and instead request restriction of its use; the data is no longer necessary for us to process, but you request it for the establishment, exercise or defence of legal claims; you object to the processing, for the period during which we verify whether our legitimate rights prevail over your rights.

e) Right to data portability – you have the right to receive your personal data from us if you have previously provided it to us in a structured, machine-readable form. You also have the right to ask us to pass on your data to another personal data controller.

f) Right to object – you have the right to object at any time, given your particular situation, to the processing of your data if we process it on the basis of our legitimate interests or those of a third party. In such a situation, we will no longer process your data with the following exceptions: (i) if we can demonstrate legitimate grounds and an interest overriding your interests, rights and freedoms and (ii) if the purpose of the processing is the establishment, exercise or defence of legal claims.

g) The right to withdraw your consent – if your personal data is processed on the basis of your consent, you may withdraw your consent at any time. Withdrawal of consent does not have retroactive effect, so withdrawal of consent does not affect in any way processing carried out prior to withdrawal.

h) Right to address the National Supervisory Authority for Personal Data Processing (ANSPDCP) – you have the right to lodge a complaint with the ANSPDCP if you consider that your personal data protection rights have been violated.      8.  What can happen if you don’t want to share your personal data with us?

In most cases, you are not obliged to disclose personal data to us. However, there are situations where we cannot process your request without additional data.

     9.  Further processing

CS Juvenes uses personal data only for the purpose for which it was collected. According to the GDPR Regulation, further processing of personal data for historical, statistical or scientific purposes is compatible with the original purpose of the processing.

     10.  Lack of automated decision-making

As a user of our services, you will not be subject to a decision based solely on automated processing of your data that produces legal effects on you or affects you to a significant extent.

     11.  How do you contact us?

To send us a request regarding your personal data, please email us at office@csjuvenes.ro.

We will inform you, within one month of receiving your request, of the action taken. This period may be extended to two months where necessary, taking into account the complexity, number of requests or the impossibility of identifying the applicant. If the time limit is extended, you will be informed within one month of receipt of the request, giving the reasons for the delay. If we are unable to identify the person contacting us, we will only be able to respond to that request if we request and receive additional information to identify the person concerned.

If we do not respond positively to your request, we will inform you of the reasons for not taking action and the possibility of filing a complaint with the ANSPDCP or the court.

     12.  Final Provisions

This Notice may be amended, in whole or in part, from time to time. Amendments are effective from the time they are posted on the website. Whenever your consent is required or requested, we will inform you. We therefore recommend that you consult this document each time you use our services in order to be aware of the version in force.
